Two disabled people have won the first stage of their legal bid to force the government to improve the much-criticised ?fitness for work? test.

The high court this week granted permission for them to bring a claim for judicial review against Iain Duncan Smith, the Conservative work and pensions secretary.

The two disabled people, both supported by the Mental Health Resistance Network (MHRN), claim that the work capability assessment (WCA) discriminates against people with mental health conditions.

The WCA was introduced by the Labour government in 2008 but is now a centrepiece of the coalition?s welfare reforms, and is used to determine eligibility for employment and support allowance (ESA), the replacement for incapacity benefit (IB).

Lawyers for MM and DM ? who have been granted anonymity by the court ? say many ESA claims are decided through assessments by healthcare professionals who are not mental health specialists.

They argue that the WCA fails to make reasonable adjustments under the Equality Act for people with mental health conditions, and are calling on the Department for Work and Pensions (DWP) and Atos Healthcare ? the private company which carries out the tests ? to seek medical evidence at the beginning of each claim.

Mr Justice Edwards-Stuart, granting permission for a judicial review, said that it was ?reasonably arguable? that ?early obtaining? of independent medical evidence was a reasonable adjustment under the Equality Act for claimant with mental health conditions and ?that this has not been done, or at least not done on a sufficiently widespread basis?.

A judicial review victory will not lead to the WCA being scrapped, but could make it fairer and less stressful for those with mental health problems, while some could be exempted from having to undergo a face-to-face assessment.

Ravi Low-Beer, MM and DM?s solicitor, from the Public Law Project, said: ?The present system results in many thousands of unnecessary appeals at great public expense, with a high success rate.

?What is not counted is the cost in human misery for those people who should never have had to go through the appeals process in the first place.

?This could be avoided if doctors were involved in the assessments at the outset. The government?s policy of bypassing doctors is inefficient, unfair and inhumane.

?We gain heart from the court?s findings that as a matter of law, it is arguable that something has to change.?

He said he hoped the judicial review hearing would take place later this year.

Dave Skull, an MHRN member, also welcomed the court?s decision, and said: ?A number of people have been wrongly assessed and misrepresented by the current situation. It is vital that there is some sort of review.?

He said many people with mental health conditions were in a ?vulnerable position? and were experiencing ?incredible anxiety? because of the WCA?s flaws, and added: ?I am supporting a lot of people who are feeling suicidal about the situation with their WCA.? ?

The MHRN was formed in 2010 by people claiming IB on mental health grounds, who were concerned about the proposed programme to reassess all those on the benefit for their eligibility for ESA.

Many of the network?s members have had relapses, episodes of self-harm and suicide attempts, and have needed higher levels of medication and even hospitalisation in the lead-up to their reassessment.

Thousands of people with mental distress have been found unfairly fit for work following their WCA, and while many go on to win an appeal against this decision, some are unable to cope with an appeal, or experience a relapse in their health as a result of the process.

A DWP spokeswoman said: ?Government welfare reforms have a long history of being taken to judicial review so this is little surprise and we will be challenging this claim vigorously.

?We have worked hard to ensure people with mental health problems are treated fairly.?

LONDON - Britain was forced to bring in military personnel at short notice to provide security for the London Olympics -- and has now done the same to help fill thousands of empty seats at several venues despite the massive public demand for tickets.

Many ordinary people who applied for tickets -- in what was essentially a lottery ? missed out and there were numerous complaints about the allocation process.

But the first day saw rows of empty seats at events including swimming, dressage, tennis, gymnastics and volleyball -- according to reports in The Guardian and Telegraph newspapers -- to the outrage of many, including U.K. Culture Secretary Jeremy Hunt.

Hunt said the sight of so many empty seats was "very disappointing," according to ITV News. "I was at the Beijing Games, in 2008, and one of the lessons that we took away from that, is that full stadia create the best atmosphere, it's best for the athletes, it's more fun for the spectators, it's been an absolute priority," he added.

London 2012 organizers LOCOG said it was looking into the issue, saying it appeared many of the empty seats were in "accredited seating areas," which are reserved for members of the "Olympic family," such as officials, athletes, their family and friends, journalists, and some corporate sponsors.

At the daily briefing Sunday, LOCOG chairman Sebastian Coe said most venues were "stuffed to the gunnels," but admitted some of the "tens of thousands" of Olympic family members had either not turned up -- on the morning after the Opening Ceremony and associated parties -- or had only gone for a short while before moving on somewhere else.

There was laughter as he was asked about the logistics of "drafting in the army" to fill seats.

"We won't be cancelling leave," Coe quipped, saying military personnel and others, such as local teachers and students, were simply asked if they wanted to see events when there were unfilled seats. Tickets were also being sold to the public, he said.

Coe, who said 75 percent of tickets went to the public, said he did not expect the situation to continue.

"I'm pretty sure this is not going to be an issue that we are going to be talking about in three to four days' time," he said, explaining accredited ticket holders would still be "figuring out" what their duties involved, transport arrangements and other logistical issues this early in the Games.

"I do take it seriously. Where we possibly can, we will get people into those seats where and when they are not being used," Coe added.

Twitter was abuzz with pictures of empty seats and criticism of the large areas without spectators at the affected events.

Sally Bercow, wife of the speaker of the House of Commons in the U.K. parliament, said in a message on Twitter that she was ?loving? the Games, but added she was ?so cross at all the empty seats. Sort it out FGS! So unfair for all of us who wanted to go :-/?

The Guardian said there were an estimated 500 empty seats at the swimming heats featuring Michael Phelps and Ryan Lochte; more than 1,000 at the gymnastics morning section, which was supposed to be sold out; and more than 3,500 at the volleyball.

The Telegraph?s report about the issue had more than 1,000 comments from readers.

What Jesse Jackson Jr.?s move to Mayo Clinic could mean

CHICAGO (AP) ? Jesse Jackson Jr.'s transfer to the Mayo Clinic in Minnesota could indicate a complicating physical illness arose during the Illinois congressman's treatment for depression, several experts in psychiatric care said Saturday.

The Chicago Democrat has been on a secretive leave of absence for nearly seven weeks, during which his office has released only occasional snippets of information, including that he was undergoing treatment for a "mood disorder" at an undisclosed location.

On Friday, the Mayo Clinic distributed a statement from the congressman that said he had been transferred there for "extensive inpatient evaluation for depression and gastrointestinal issues." The clinic would not release more information Saturday.

John Anderson, of the Associates in Psychiatry and Psychology in southeastern Minnesota, said people receiving psychiatric care are often transferred to the Mayo Clinic when a physical illness develops because both can be treated there.

"Mayo does an excellent job in terms of combining those, so they can treat what's essentially a dual diagnosis," he said.

He noted specifically that Mayo Clinic has a highly rated gastrointestinal department as well as a free-standing inpatient psychiatric unit.

Jackson underwent a procedure in 2004 to help him lose weight that involves removing part of the stomach and rearranging the intestine. Phone messages left Saturday for Jackson's spokesman weren't immediately returned.

Friday's statement was the first to mention a gastrointestinal illness, and it was not known whether that was related to his depression or an entirely separate medical issue.

The statement did not disclose where the longtime Chicago congressman, the son of civil rights leader Jesse Jackson, had been staying previously.

He went on leave June 10, though his office didn't disclose it until weeks later and has been mum on details ever since. Initially, his office said Jackson was being treated for exhaustion. But his staff later said Jackson's condition was more serious and required inpatient medical treatment. They also said Jackson has been grappling with emotional issues.

Under mounting pressure from his colleagues and constituents, his office released a statement last month from his unnamed doctor saying Jackson was receiving intensive medical treatment at a residential treatment facility for "a mood disorder."

The timing of his medical leave has raised questions, in part because Jackson is facing an ethics investigation in the U.S. House connected to imprisoned former Illinois Gov. Rod Blagojevich.

The House Ethics Committee is investigating allegations that Jackson was involved in discussions about raising money for Blagojevich's campaign in exchange for the then-governor appointing him to President Barack Obama's vacated U.S. Senate seat. Blagojevich is serving a 14-year prison sentence for corruption.

Jackson was not charged and has repeatedly denied wrongdoing.

Jackson faces Republican and independent candidates in November, though he's widely expected to win re-election. He first won office in a 1995 special election and has easily won each race since. His district includes parts of Chicago and some suburbs.

Former Alaska Gov. Sarah Palin has endorsed U.S. Rep. Jeff Flake in Arizona?s bitterly contested Republican Senate primary.

Palin, a part-time Arizona resident and the 2008 GOP vice-presidential nominee, praised Flake as ?a proven conservative crusader? who is ?not afraid to ?go rogue? against his own party and its leadership.?

Palin?s endorsement, announced Monday, comes more than a week after GOP Sens. Jon Kyl and John McCain threw their political support to Flake, a six-term congressman under heavy fire from Republican Senate rival Wil Cardon, a Mesa investor who so far has loaned $7.5 million of his own money to his campaign.

Although Flake has long been known for his fight against congressional earmarks and is backed by fiscally conservative organizations such as the Club for Growth, the National Taxpayers Union and FreedomWorks for America, Cardon has been attacking his reputation through a series of TV commercials. One Cardon ad in heavy rotation recently says Flake is ?not honest on conservative issues.?

Palin noted that Flake is ?credited by many as the leading anti-earmark crusader in the House? and often clashed with fellow Republicans over wasteful spending.

?I?ve spoken often about the need for sudden and relentless reform of government,? Palin said in her letter to Flake that announced her support for him. ?Jeff is just the sort of ?relentless reformer? we need in the Senate. Polar bears may have trod the planet for millions of years, according to a new genetic analysis. That suggests the white-coated, massive bears have weathered previous natural climate changes, and may predate the Arctic ice that is their preferred?and only?habitat today, which is why the species future remains uncertain presently.

"There's no guarantee that they'll survive this time," says geneticist Webb Miller of Pennsylvania State University, an author of the study published July 23 in Proceedings of the National Academy of Sciences. After all, Miller notes, the species currently lacks much genetic diversity to help it adapt to changing conditions as well as facing unprecedented threats such as heavy metal pollution accumulating in the Arctic. By better understanding how old the species is, the scientists hope to better understand what might be done to allow the polar bear to cope with onrushing climate change and other existential challenges.

By analyzing the genomes of 28 bears?polar bears, including a roughly 120,000-year-old specimen from Norway's Svalbard archipelago, as well as modern brown bears and black bears?the scientists in effect read back in time to a common ancestor at least four million years ago. That finding conflicts with a genetic analysis published in Science earlier this year that suggested the species was only 600,000 years old or so, which the team behind the new research suggests may result from misreading past interbreeding events with closely related brown bears.

In fact, the key problem here may be that technically the polar bear may not be a species at all. "If one defines that two species separate as when they cannot produce viable offspring, then perhaps brown bears and polar bears aren't yet separate species," Miller admits.

What makes a polar bear a polar bear? There's the white coat and black skin as well as less visible differences like a thicker layer of subcutaneous fat layers and richer milk. These and other unique features of adaptation to the harsh conditions of Arctic life have convinced biologists that the polar bears represent a unique type of animal?a species of its own. After all, the brown bear that is its closest living relative lacks all of these adaptations, looks different, eats different food and would not fare well in the harsh conditions out on the Arctic ice.

Yet, brown bears and polar bears, when they meet, can mate, as evidenced both by the genetic record and observations in the wild. Because polar bears have been spending more time off the ice in recent years, they appear to have begun to interbreed with adjacent brown bear populations, and some of these hybrids are into their second generations. If the basic definition of a species is a group of organisms capable of mating and producing fertile offspring only within their own group, the polar bear and brown bear fail to qualify.

Such interbreeding between bear species makes genetic analysis that much more difficult. After all, if the species interbreed even once, that single event can appear to determine the point at which the two species diverged if a scientist happens to analyze only the portion of the genome influenced by that mating event. And the mixing of genetic material has been going on for a long time between polar and brown bears, making disentangling their genetic history that much harder.

The 40-Below Public Arts Task Force wants to create a light installation to add some zip to the tunnel, making it ?a destination place in the city that offers a picture of vibrancy and innovation.? Dr. Rod Zent, Executive Director, Texas A&M Educational Broadcast Services, Tony Hockenberry Coordinator, Interactive Communications, TTVN Trans Texas Video Conferencing Network, and Andy Howard, Founder and Managing Director of Howard and Associates will address the issue of How to Integrate Visual Communications Into the DNA of Your Organization on July 19, 2012 at 1:00 PM EDT. Derek Abrams, CVE, VSG, a VCI-Group Board member and Manager of Managed Communications Services for Oregon State University, said, over 38% of our members asked us to focus on the issue of governance and how to make certain that visual communications tools are adopted and deployed to the benefit of their organizations. This panel is designed to help our membership understand how to create and deploy visual communications plans and governance that become part of their day to day communications landscape; plans that actually support and accelerate the adoption and deployment of visual communications governance and technology. Two of our panelists have deployed technology, systems and governance throughout the state of Texas, and have grown a core TTVN network that consists of over 120 primary wide area network sites and more than 300 videoconference sites.

The panel will also address governance in a corporate environment, something with which Mr. Howard has helped dozens of corporate end users. Too often organizations deploy visual communications with the mentality of build it and they will come. However, successful organizations start with a plan that addresses how their users will integrate visual communications into their daily work processes and how these products will be managed and by whom. These successful environments see utilization increase by orders of magnitude, thus ensuring a successful ROI.

In addition to the discussion about how and when to create and integrate policy along with communications technology, the panel will discuss the benefits of strong policy when deploying leading edge visual communications tools. It is not enough to deploy the right hardware, software and networks, continued Abrams, we have found that the organizations that succeed in our environment, have a visual communications plan integrated into the fabric of their business practices and operations.
